The right to transport: the obligation to accept passengers

Article L. 3121-1 of the Transport Code sets out a clear principle: a taxi is a vehicle assigned to public passenger transport. A cruising taxi driver (available vehicle in circulation) or one stationed at a taxi stand has the obligation to accept the first customer who presents themselves.

Cases where refusal is permitted

The driver may refuse a ride only in very limited cases provided by law:

  • The customer is severely intoxicated and risks compromising safety or soiling the vehicle
  • The customer requests a route that would endanger the driver (dangerous area at night, for example)
  • The vehicle is going off duty (flashing orange light)
  • The customer has a non-domestic animal or large animal that cannot be contained
  • The number of passengers exceeds the vehicle's capacity

What does NOT constitute grounds for refusal

The driver does NOT have the right to refuse a ride for the following reasons:

  • The ride is too short (even 500 meters)
  • The destination is in the suburbs or a remote area
  • The customer wishes to pay by card
  • The customer is a person with reduced mobility (if the vehicle allows it)
  • The customer has luggage (within reasonable limits)
  • The customer's appearance (discrimination is criminally punishable)

Any unjustified refusal is punishable by a 4th class fine (135 euros) and may constitute an act of discrimination.

The right to regulated and transparent fares

Fares set by prefectural decree

Unlike rideshare services, taxi fares are regulated by prefectural decree. Each year, the prefect sets the maximum fares that drivers cannot exceed. In 2026, for Parisian taxis:

The mandatory kilometric meter

Every taxi must be equipped with an approved kilometric meter (taximeter) that is sealed by an authorized body. The meter must:

  • Be visible to the passenger (legal obligation)
  • Be running from the start of the ride
  • Display the applicable rate (A, B, C, or D)
  • Display the ride amount in real time

A driver operating with a meter that is hidden, off, or tampered with commits a criminal offense.

Airport flat rates

For trips between central Paris and Parisian airports, mandatory flat rates have applied since 2016:

These flat rates are fixed, identical day and night, and cannot be increased.

Authorized surcharges

Only certain surcharges are authorized, and they must be displayed in the vehicle:

  • 4th passenger: maximum 4 euro surcharge
  • Heavy luggage (over 30 kg): variable surcharge depending on department
  • Booking: 4 euro surcharge
  • Animals: no surcharge is authorized for small animals

Any other surcharge (cleaning, mandatory tip, return fee, etc.) is illegal.

The right to choose the route

The principle

The passenger has the right to choose the route for their ride. If you know a shorter way or wish to avoid certain roads, you can tell the driver, who must comply.

In the absence of a preference

If the passenger does not specify a route, the driver must take the shortest route or, if traffic conditions justify it, the fastest one. They may not take detours to inflate the fare.

Recourse in case of abusive detours

If you notice a clearly unjustified detour, you can:

  3. 3.Contest the amount on arrival if the detour is not justified

The right to pay by bank card

The 2014 law

Since Law No. 2014-1104 of October 1, 2014, all taxis are required to accept payment by bank card. This obligation applies with no minimum purchase: even a ride of 8 euros (the minimum fare) must be payable by card.

Payment terminals

The driver must have an electronic payment terminal (EPT) in working order. Classic excuses such as "the terminal is broken" or "I have no signal" are not acceptable: the driver is obligated to maintain their equipment in working condition.

Accepted payment methods

The taxi must accept:

  • Bank cards (Visa, Mastercard, CB)
  • Cash in euros
  • Checks (unless otherwise displayed)

The driver may not charge additional fees for card payment.

In case of refusal

If a driver refuses card payment, you can:

  • Remind them of their legal obligation (law of October 1, 2014)
  • Photograph the vehicle plate and license number
  • Report the offense to the prefecture or the DGCCRF

The right to a receipt

The delivery obligation

At the end of each ride, the driver is required to issue a receipt to any passenger who requests one. For rides exceeding 25 euros, the receipt is mandatory and automatic, even without a request from the passenger.

  • The date and time of the ride
  • The taxi number (license number)
  • The pickup and drop-off addresses
  • The total amount of the ride

The right to refuse a taxi

  • The vehicle is dirty or in poor condition (torn seats, unpleasant smell)
  • The meter is not visible or not in operation
  • The driver is unable to present their professional card
  • The vehicle does not have a visible taxi plate and roof light
  • The driver refuses to take you to your destination without valid reason
  • The driver refuses card payment

How to verify taxi compliance

Before boarding, check the following:

Passenger obligations

What the passenger must respect

Rights come with obligations. As a passenger, you must:

  • Pay for the ride according to the fare shown on the meter or the applicable flat rate
  • Respect the vehicle: do not soil, damage, or degrade the interior
  • Wear your seatbelt (mandatory since 1990)
  • Not smoke in the vehicle (offense punishable by 68 euro fine)
  • Not demand a dangerous route (speeding, wrong way)
  • Not distract the driver in a way that compromises safety
  • Respect the maximum number of passengers (generally 3 in the back + 1 in the front)

Tipping

Tipping is not mandatory in France. It is left to the passenger's discretion. The common practice is to leave between 5 and 10% of the ride amount, but this is by no means an obligation.

What to do in case of a dispute

Step 1: Dialogue with the driver

In case of disagreement (disputed amount, detour, card refusal), first try a courteous dialogue with the driver. Note the following information:

  • The taxi number (on the plate and roof light)
  • The driver's license number
  • The date, time, and route taken
  • The amount demanded and what you believe is fair

Step 2: Complaint to the prefecture

If dialogue fails, you can file a complaint with the prefecture of the department where the incident occurred. For Paris, this is the Prefecture de Police, Bureau des taxis et transports publics (Taxi and Public Transport Office).

Information to provide:

  • Your full contact details
  • The taxi and driver number
  • Precise, dated, and detailed facts
  • Any evidence (receipt, photos, testimonies)

Step 3: The transport mediator

In case of an unresolved dispute, you can contact the Transport Mediator (free mediation). The mediator examines the case and proposes an amicable solution within 90 days.

Step 4: The DGCCRF

For serious offenses (abusive fares, systematic card refusal, scams), you can report the driver to the DGCCRF (General Directorate for Competition, Consumer Affairs, and Fraud Prevention).

Step 5: Criminal complaint

In cases of proven discrimination (refusal based on origin, disability, appearance), you can file a complaint at the police station or directly with the public prosecutor. Discrimination is a criminal offense punishable by 3 years imprisonment and a 45,000 euro fine.
